JBCC NOMINATED/SELECTED SUB-CONTRACTOR AGREEMENT WORKSHOP COMING UP IN KWAZULU-NATAL
A JBCC nominated/selected sub-contractor agreement workshop will be presented at the ECA(SA)’s KwaZulu-Natal regional office on 29 September. Presented by Roelf Nel, practising attorney and author of a number of contractual articles in the ECA’s magazine, SA Electrical Contractor, the workshop will cover important provisions in the Minor Works Agreement (MWA) and the Nominated/Selected Sub-contractor Agreement (N/S). Delegates will gain an understanding of the overall structure of the JBCC suite of documents. This informative workshop will bring clarity to a number of issues faced by electrical contractors, including:
• Different types of sub-contractors recognised by JBCC;
• Main obligations of the parties to the contract;
• Remedies given to the main contractor when sub-contractors delay or breach;
• Design responsibility;
• Programming the work of sub-contractors under the JBCC;
• Contractors’ instructions;
• Stages of completion with particular focus on interim completion;
• Damages for non-performance vs penalties; and
• Termination of sub-contract agreement.

About the presenter
Roelf Nel regularly presents CPD-accredited JBCC workshops and talk to all stakeholders within the building industry. He is a practising attorney and managing director of Roelf Nel Incorporated, a firm of infrastructure project attorneys. He regularly presents workshops for the Pretoria Institute for Architecture (PIA); the Gauteng Institute for Architecture (GIFA), the Free State Institute for Architecture (FSIA), the KwaZulu-Natal Institute for Architecture (KZNIA), Master Builders’ (SA) North (MBSANorth), and the Royal Institute of Chartered Surveyors (RICS).
He is a RICS-accredited civil commercial mediator and a member of the Chartered Institute of Arbitrators (MCIArb). He serves as a mediator on the RICS President’s Panel Of Mediators and the South African Institute of Civil Engineers (SAICE) President’s Panel Of Mediators.
